1.ASSUMPTION OF RISK

The Client and guests understand that a private chef experience carries inherent risks, including but not limited to:

  • Potential food-related illnesses, allergic reactions, or sensitivities.
  • Possible kitchen accidents (burns, cuts, or injuries)
  • Risks associated with consuming cannabis-infused foods (if applicable)

The Client acknowledges they have been advised to disclose any food allergies, dietary restrictions, or medical concerns prior to the event.

2. REPRESENTATIONS & WARRANTIES

The Client and guests confirm that they:

  • Have disclosed all known food allergies and dietary restrictions in advance.
  • Understand that Cabar Solutions LLC is not responsible for undisclosed food allergies or sensitivities.
  • Accept full responsibility for the actions of their guests during and after the event.

3. RELEASE OF LIABILITY

The Client and guests release and discharge Cabar Solutions LLC, Chef Cristian CB, and all affiliated parties from any and all liability related to:

  • Personal injury, illness, allergic reactions, or adverse effects from food consumption.
  • Property damage or kitchen accidents at the Event Location.

4. INDEMNIFICATION

The Client agrees to indemnify and hold harmless Cabar Solutions LLC from any claims, damages, costs, or expenses (including attorney fees) arising from:

  • The Client’s guests, improper kitchen use, or undisclosed dietary restrictions.
  • Any incidents or conditions at the Event Location beyond the chef’s control.

5. KITCHEN USE & SAFETY AGREEMENT

The Client confirms that:

  • All kitchen appliances (stove, oven, refrigerator, sink, etc.) are in working condition.
  • The cooking area will be clean and free of hazards before the chef’s arrival.
  • The chef has the right to decline use of any unsafe equipment.

The chef will follow proper sanitation, food safety standards, and will not be responsible for pre-existing food contamination.

Post-Event Cleanup:

  • The chef will clean used surfaces, equipment, and cooking tools.
  • The Client is responsible for trash disposal unless otherwise agreed.

7. GOVERNING LAW

This Agreement is governed by the laws of Florida, with disputes resolved in FL courts.

8. SEVERABILITY

If any provision of this Agreement is found unenforceable, the remaining provisions shall remain in effect.

9. VOLUNTARY PARTICIPATION & SIGNATURES

By signing below, the Client and guests confirm they have read, understood, and voluntarily agreed to this Waiver, Release of Liability, and Kitchen Use Agreement.
